【Divergent Terms of Use】

Article 1

1. 「Divergent」(referred as ”Divergent”) is social recruiting internet website service (including all the URL of http://www.divergent.tokyo recruiting website link to http://www.divergent.tokyo) of TRIPBIZ Co. Ltd., (referred as “Company”) All the email from the website and recruitment service from Divergent will be included.

2. Person who received the recruitment service including email from Divergent (referred as “User”) with own intention and responsibility to use Divergent.

3. User entered their personal information in Divergent will be responsible of their own action.


Article 2 (About the registered email and password)

Members will need to register with their applicable email address and the management of personal email will be own responsibility, please renew the email address once you had made any changes. Members are responsibility for their own email address and password to prevent illegal use. Members are not allowed to pass and apply their email address and password to third party. If the damaged caused due to misused of registered email address and password by third party, Company will not be responsible for the action. Members will need to register with their applicable email address and the management of personal email will be own responsibility, please renew the email address once you had made any changes.

Article 3 (Cancel Registration, Stop of Service)

In Company, if there are any situations applicable below, Company is not responsible to inform in advanced but to cancel the membership.

(1) Published inappropriate contents.

(2) Using ID or password for dishonesty.

(3) Any action against the rules.

(4) After member registration, never login over a year.

(5) Others. Unsuitable action judged by Company.

Any damages causing by the situation mentioned above, Company will not e responsible.


Article 4 About Prohibited

1. The action of User in Divergent, if User has offended below from 1-9 with the judgment from Company

(1) Activities of intending on registering/providing fake information

(2) Using or registering personal information, which is not belonging to oneself to conduct any activities related.

(3) Activities on violation copy right, trademark right, privacy right, legal name right, portrait rights and reputation

(4) Activities on slanderous defamation of person or group

(5) Activities against legislation, public order and standard of decency.

(6) Activities on offending benefits of third party

(7) Activities on proving information of Divergent for profit making, advertising, publicity, specific thought or persuasion on religions.

(8) Activities in damaging or obstruction operation or reliance of Divergent

(9) Activities against the purpose of Divergent operation

2. If judgment from Company that User against any of 「Divergent Terms of Use」 , Company has the right to stop User’s right in using all or parts of service in Divergent without priory notices. Also if there are any actions against 「Divergent Terms of Use」 will then be judged by Company then decided to defeasance previous interviews or upcoming interviews etc. Company will have right to decide. Once the service has been terminated or removed by Divergent, any disadvantages caused will not be the responsible of Divergent.

3. Companies which public their advertisement for recruitment at Divergent will be regarded as observing the first item of this aritile and other published orders of Divergent.


Article 5 (About Withdraw Membership)

Members need to follow the Company rules on withdrawing membership, while Company receiving data then they will process with application. Company will have no more responsibility to keep and maintain the registered information and contents.


Article 6 (About Contents Copyright)

Copyrights and other rights on Contents included in the Website shall belong to Company, authors or other parties who creates Contents. Contents published on the Website by Members (as far as not exceeding the extents of publication allowed by Members), within the scope necessary for advertisement and promotion of the Website and smooth provision, improvement, maintenance, etc. of Services. Companies entitled to worldwide, non-exclusively and free of charge use (the second time user and third party designated by Company will be included with permission for use same as mentioned below). With the judgment of Company, User will be able to apply all the scope necessary for advertisement and promotion of the Website and smooth provision, improvement, maintenance, etc. of Services. Companies entitled to worldwide, non-exclusively and free of charge use. The copyright if User related to this article will not be applicable.

Article 7 (Response of Violation, etc.)

1. If User to be found member of gangsters group, related to gangsters group or even if not a member of gangsters group within 5 years, companies related to gangsters group, professional trouble makers on social activities, any activities violent (All we be called 「Gangster group」) Please make sure if you have any situations mentioned below or not being in the situation in the future.

(1) Recognizes related to member of gangster group or managing business of gangster group

(2) Admitted related to member of gangster group or managing business of gangster group

(3) If damage benefit of third parties for purpose of own benefits and related to any gangster group and admitted the relationship with gangster group.

(4) Admitted receiving of the offer f capital from gangster group or any offers has been conducted before

(5) Operation or holding the stock of business and employers are related to gangster group.

2. If a User is found to have violated Agreement. Or otherwise Company considers necessary with a User, Company may, but is not obliged to, take any of the following measures against the User:

(1) To require the User to stop the violation and not repeat any identical or similar act;

(2) To delete the contents or use other methods to correct the violation;

(3) To disclose the violation inside or outside the Services (including but not limited to notifying the police or other public agency of a crime or the like);

( (4) To suspend provision of Services to the User

(5) To disqualify the User for the Services


Article 8 Responsible of Company

1. While User is damaging (Including Emotional distress, all of disadvantages including the interruption, or other monetary loss of job hunting) by Divergent (Including information provided by Third Party), except for Intentionally or negligence by Company, basically Company will not be responsible. If the damage is caused by the service provided Third Party through Divergent or any promoteon, information provided by third party will not be responsible of Divergent. Even in the case that Company will be responsible will be limited to damage caused by Company.

2. Company, Divergent will not provide any grantee for the error or obstacle occurred.

3. Information provided by Divergent (Company information about Third Party, advertisement or information provided by Third Party) It will be responsible by the Third Party and User will need to provide real, legal, safe, suitable and useful information and also understand that Company will not be grantee for any accuracy information or product, job and information will be satisfied from Divergent or through Divergent.

4. Company will have virus protection but if things like power failure, server damage, wireless damage and other nature damage will not be responsible by Company (Refer to 「irresistible matters」). If lost or damage of data lost change by the Irresistible matter then Company will have no responsible. Users will need to be aware to keep about their own data.


Article 9 Personal Information

It will be called「Privacy Policy」, Company will be responsible in collecting, using, managing and keeping.


Article 10 Collection and use of statistical and attribute information

Company may prepare Members’ usage histories of Services (including but not limited to page-viewing, application for Plans for Members, acceptance of invitation to and participation in Plans for Members and sending and receipt of e-mail), and statistical data, attribute information, etc. by processing, totalizing or analyzing such usage histories, Registered Information, etc., in such manners as no specific persons can be identified, and peruse and use such usage histories, statistical data, attribute information, etc. (including but not limited to allowing Recruiters to browse, development of new functions of Services and survey of markets), which Members shall in advance approve.


Article 11 Changing Service of Divergent

Company is able to change service of Divergent without any notification; it can be temporarily or long-term stop even termination the service.


Article 12 Change Terms of Use of Divergent

Without any advance notification, if there are any needs of changing the [Divergent Terms of Use]. While using the service of Divergent, user was commenced consent of this Terms of Use as result users are responsible in checking latest [Divergent Terms of Use] before they using the service of Divergent.


Article 13 Languages of terms of use

The current form of [Divergent Terms of Use] is expressed in four languages: Japanese, English, Simplified Chinese, Traditional Chinese. If any kind of trouble occur on account of the difference of language. The Japanese form shall prevail.


Article 14 Applicable law and jurisdiction

Divergent and Terms of Use are all according to legislation of Japan and all disputes occurred from Divergent will be judged exclusively by first instance of the court from Tokyo District Court or Tokyo Summary Court.
